I came with B1 to work until i obtain H1b (this is B1 in lieu of H1 clause that authorize me to work). I was not selected at 2013 H1b lotery.
How long can i stay on B1: 6months + one renewal, would the second renewal be granted,
I am looking at L1b as an alternative but i did not complete the one continuous year before coming to US with my employer. Can the company "make up" some months of work abroad to complete the 12 months? How deep are they digging into for L1b?

No making up please, unless federal prison is a part of our career plan. B-1 in lieu of H-1 is uncertain, but you can keep trying extensions. If the new law for comprehensive immigration reform passes, things could change drastically.

L1B extension rejected, re-applying for L1A
Hi,
My L1B extension application got rejected in Nov 2012. As my client wanted me to be placed in US, my company applied for L1A Blanket, which also got denied. Some people in my company is saying that, I need to wait till Nov 2013 before applying for L1A Individual. Is that true.
My understanding is that USCIS will check for my period of employment before entry into United States. ie. period before my first entry in Oct 2009. Can you please help me

I am Dutch and currently halfway in my two-year education in order to become a railroad engineer. I intend to work for a Dutch rail operator owned by Genesee & Wyoming. Can I apply for an L-1 visa after working for them for one year, or should I go for the EB-3 visa instead?

I am looking for some guidance around qualifying for a L1 visa.
I was previously working with a multinational american company (Company A) in Brazil. I worked with Company A from 11/2010 to 03/2013 in Brazil. I've left company A to join company B in Brazil. However, company A might have a position in the USA that I would like to pursue. I would like to find out if If I would still qualify for L1A Blanket visa with Company A even if I am not currently employed by Company A in Brazil at the time of the application.

First of all, I need to appreciate the guidance that you are providing as a mentor. I have a case where my L1ext was applied in Dec (just 14 days before my visa & I-94 expiry). Although working for a giant american co. (top 4 co.'s) got a RFE in last week of Jan. Responded and received by USCIS Vermont in last week of March. On their site, it shows RFE response review & would make a decision in 60 days of the received date. I have some urgent travel plans in May last week (60th day) to leave US. What are the chances of USCIS jumping over these 60 days to make a decision?

From your question, it seems I can always travel back to my home country legally with the extension pending. This is because, I sensed from someone that ideally it would not be a good idea to leave US while the extension is pending. But, unfortunately I have to attend a function in my own family and my presence is equally important. Hence, I was curious to know about this.
Also, can the CBP or Immigration authorities question me about my overstay? Sorry for such basic questions, but I have never left US time since I came here. So, really don't know if I could face issues.

Rajiv Sir,I am on L1B petition since 2006.My first travel was from Feb 2007 to May 2007.I came back from July 2007 to Oct 2007.Later I stayed in India for 13 months.In the current visit,I have been staying since Nov 2009 till date.In between I had gone to India on vacation for 18 days.Based on these dates USCIS has issued my latest petition renewal and I94 until Nov 27 2013.My company raised a concern saying that my 5 year term ends on May 1 2013 as the clock was not reset.They are asking me to leave immediately.I called the USCIS,they say I can legally stay and work till Nov 27 2013.Pls help.

It looks to me like the clock would be reset giving you full 5 years after your continuous 13 months stay outside USA. I don't see why not.

But my company says the clock has not reset in my case as I traveled on the same visa stamping after 13 months in India [I did so because my visa stamping was still valid].Is that true, please help as your answer can change the plans now.Also is there any written guideline that can convince my company to show that I can legally stay as per USCIS issue date.

My L1 Visa is getting expired (5 yrs Completes), GC - I140 is approved.
Can i get extension thru I140 with L1 visa? or do i have to file a H1 Visa?

L2 visa - EAD wait from abroad?
Hi,
I will be applying soon for an L-2. Can I apply for the EAD before entering the US and wait for its approval from abroad? I already have a SS and had an EAD two years ago (not sure if this would change anything).
I am asking because I would rather work for another 2 months instead of having to wait for my EAD without income.

I am a L2 visa holder and applied for EAD. USCIS has asked for Principal Alien's Form I-797A, Notice of Action for status or extensions of stay in US.
We don't have this form and not aware what is it.
Please advice.

L1 A - Job Change
Hi: I am on L1 A (been about 4 yrs) from company A and in closing stages of getting a very good offer from company B. Both A & B are global corporations. For company A, I oversee business across continents (Both North America & Latin America). Company B is very keen on having me onboard.
Three questions - i. What are ALL the possible options on visa front so that I can join company B. ii. What is the quickest option that can help me get on to B? iii. If I want GC, can company B file for it when am still on payroll of company A - if so, can it be EB1?

Since A and B are not related, H-1B is the only obvious option to join B. B can start your green card even before you join, but it will not be EB1 (international manager/exec.).

currently I am working for Infosys in India, came to US on L2 Visa on vacation I got my L2-EAD and Infosys offered job in Wisconsin with L2 EAD status. Can I ask Infosys to do a change of status from L2 to L1. Or better stay in L2?

1 year break after L1B expired
My L1 B visa expired on May 27 2012 (completed 5 years in the USA) and I returned back to India. It seems that I need to wait for 1 year before I can re apply for L1 or H1 visa. Does this mean that I can apply only after I complete 1 year out of the US, or does it mean I should be out of the US for 1 yr by the time my petition gets approved ?
