USCIS provides Information on Filing Form I-539

USCIS reminds applicants to include all required evidence when submitting Form I-539, Application to Extend/Change Nonimmigrant Status. The required initial evidence for nonimmigrants requesting an extension of stay is included in the instructions for Form I-539. Initial evidence is required for all applications regardless of whether they are electronically filed in USCIS ELIS or mailed to USCIS. 

Fill out your application completely and provide all required information or your application may be delayed or denied. USCIS encourages all individuals filing Form I-539 to first review the list of Helpful Filing Tips. Also, keep these additional tips in mind: 

  • Upload all required evidence at the time you file your application in USCIS ELIS;
  • If USCIS ELIS has already accepted your case, you may still submit evidence at any time until USCIS makes a final decision; and 
  • You can upload evidence by logging into your USCIS ELIS account, clicking “View My Cases,” and then clicking “View/Submit Additional Documents for Consideration.” 
     

It is especially important for individuals who hold a B-2 visitor visa to submit needed evidence with their application, as there are no appeal rights for B-2 nonimmigrants who are denied an extension of stay. If you have a B-2 visitor visa and are seeking to extend your stay, please remember to include the following documents with your application:

  • The original I-94, Arrival-Departure Record, or a front and back copy;
  • A copy of your passport; and 
  • A statement explaining why you are requesting an extension of your stay in the United States.
