Bottomline: BALCA appeals take approximately 3.5 to 4 years from the date the appeal is filed. 

- Appeals from PERM denials with BALCA office are currently taking about 3.5 - 4 years from date of docket

- Dockets are being completed within the same month that they are received

BALCA:   The Board of Alien Labor Certification Appeals is an administrative body which reviews appeals against denials of PERM labor certification cases. BALCA also handles a number of Department of Labor review cases. For more information visit this link:

Workflow of appeal: Appeal is filed with Certifying Officer ---> CO Prepares the file and sends it to BALCA ---> BALCA (basically) dockets the appeal after notice to parties
