DREAM Act Updates - 10/27/03

The Dream Act with its poor requirements was voted out of the Full Senate Judiciary Committee. The Senate Judiciary Committee, on October 23, passed S.1545, the bipartisan DREAM Act (Development, Relief, and Education for Alien Minors Act of 2003) by a 16-3 vote. The amendment was received by an 18-1 vote. This amendment supported by Senators Feinstein (D-CA) and Grassley (R-IA), would alter the DREAM Act in these ways :

  • It would remove the community service options as a way to lift the conditional residency status. The other two options remaining are through two years in the military or two years in college
  • The beneficiaries of this act will be not be entitled for the federal financial aid grants, which includes the Pell Grants and Federal Special Education Opportunity Grants. Students will be entitled for federal loans and work study programs.
  • Beneficiaries of the DREAM Act to register in SEVIS, a system to track foreign students.
  • Alter the retroactivity provision by which the DREAM Act beneficiaries who have fulfilled the education or military service options before the date of  passing of the Act would be  required to wait an additional 3 years in conditional status in order to qualify for full LPR status.
  • Elucidate that the bill’s high school graduation needs must be  fulfilled by graduation from a U.S high school
  • To add a new requirement for DREAM beneficiaries to list all secondary education institutions attended in the U.S. on the petition in order to lift the conditional status.

As this important legislation has moved out of the committee on a strong vote, legislators supporting this bill will work to strengthen the bill.
