It was a long and painful journey of seven years. But, at the end I finally got my GC. Through out this procedure the only positive thing was the help and support I received from Mr. khanna's office. I first applied EB-3 in 2006. Got my EAD through EB-3 application. Then reapplied for EB-2 in 2012 and got my GC in August, 2013. Through out the process Mr. Khanna and his staff was so helpful and thorogh that it made my journey lot easier. I would specially like to mention Suman, Mathew, Seema and Bharathi for all their help extended to me. I can not experess enough thanks to them. I would recommend Law offices of Rajiv Khanna for anybody whoever need any help on immigration issue. They are simply the best immigration attorney in this country!

EB-2 Visa for a Veterinary Assistant

Question details

I live in Bulgaria and I have a Master's Degree in Veterinary Medicine. My question is can I get a EB-2 visa if I work as a veterinary assistant in the USA ?

You can qualify for EB2 only if two conditions are met:

1. Your degree is equivalent to a U.S. advanced degree (a credentials evaluation service needs to assess that under proper standards); and

2. The job requires an advanced degree or equivalent experience.

I-140 RFE – Progressive Experience

How does one prove that five years’ experience gained while working for one employer, with one job title is progressively responsible in nature? 

That issue was key in a recent EB-2, I-140 petition. USCIS issued a Request For Evidence (RFE) alleging that although the employee had the requisite experience, he had failed to establish that his experience had grown progressively responsible after receipt of his Bachelor’s degree.

PERM Proof of Advertising Materials

We represented a consulting company and their employee, a Senior Quality Assurance Analyst.  USDOL had denied PERM certification after an audit holding that we had failed to submit tear sheets from our Sunday advertisements.  We filed the appropriate motion establishing that it was highly likely, if not certain, that the tear sheets were in fact submitted.  We provided evidence from our files, affidavits, and proof of our firm’s normal business practice.The case was approved in less than three weeks.

EB-2-NIW–Physician in MUA

We represented a physician working for a healthcare network within several counties of a Medically Underserved Area (MUA). Initially, we submitted the required documents, but the tricky issue was the division of the physician’s service over several counties. The approval in this case required that we work closely with officials from the State Health Department to provide proper documentation and verification of the full-time nature of the job, albeit across several areas and proof of physician shortage within each area.

I had several pending I-485 application family-based as well as employment based. I withdrew family-based yet I received an interview notice for the same.
