Rejection of Cases at Texas Service Center due to Fee Amount
The TSC has indicated that they have had
filings at the Texas Service Center that were postmarked before
April 30, 2004 either rejected or subjected to a "balance due" bill
for the new fees. The USCIS regulation implementing the new fees
indicated that, as long as the petition or application was
postmarked before the April 30 effective date, the old fees would
apply. Now TSC is planning to correct the error for the cases which
should have accepted with the old fees but did not.
Update from Texas Service Center on H-1B Rejections
The
Texas Service Center admits that there were flood of rejections of cap-subject H-1Bs filed after April 1, 2004. TSC informs that these
rejections were in error and hence advises people to re-file
immediately. The mail room is under instructions not to reject an
H-1B filing that has a "start date" on the I-129 of October 1 or
later (as long as the "later" is not more than 6 months from the
date of filing)
