Processing dates
For all major categories the center (NSC) is processing from Dec. 14. EB-1s are behind the timeline but the center currently has trained additional officers who are working on this timeline.
Transfers of I-485
Transfers of I-485s are allowable from one petition to another usually. But visa availability and the viability of both underlying petitions could be factors whether or not the transfer of the I-485 is allowed. When it is evident that the originally filed I-140 petition is deficient or is not approvable transfers of I-485s are not usually allowed.
Also while transfer of the I-485 correspondence should be included to the new petition requesting the transfer. In order to ensure that the request for transfer is considered as each case moves through processing in a separate manner it is advisable to direct a similar request to the I-485 mailing address.
Note: A visa must be available to the time of filing and at the time of transfer of an I-485.
EAD renewal before expiration
USCIS has 90 days from the date the USCIS receives the I-765 within which to complete adjudication of the application as accordance to 8 CFR 274a.13(d). Hence for an EAD to be renewed before its expiration, applications for renewal should be received by the Service 100 days prior to expiration. An I-765 (c)(9) application filed within 120 days of the expiration of the previous EAD can be accepted and adjudicated. USCIS does not plan to change the 120 day in advance of expiration filing period for I-765 and I-131 extensions.
AR-11 and address change
AR-11 goes to the Address Change Team when an applicant files an AR-11 and mails it to the service center. The address is usually updated on any pending applications that may be on file at NSC when an A-number is listed on the AR-11. The change of address can also be completed by the applicants on - line and that address change will be create a SRMT (Service Request) through the on-line data base. This change of address will then be sent to the Service Center that relates to the receipt number (LIN, MSC, WAC, EAC, SRC). But the receipt number could be pending at a different Service Center/District Office. The center's (NSC) contact representatives can transfer the SRMT to the correct office that holds the file once the CCS Unit sees that the receipt number is transferred out.
Refilling for an EAD replacement
When a new I-765 is filed with a new fee in order to replace a lost EAD the applicant has to be sure to annotate the I-765 that the applicant would like the validity to be one year from the date of adjudication as the first card was lost and no benefit was received from it.
I-485 filed prior to the fee increase
For applicants who filed the I-485 prior to the fee increase (before July 30, 2007) will need to file for a renewal EAD by submitting an I-765 application and paying the regular I-765 fee for a renewal. However if the lower 485 fee was paid, then any I-765 or I-131 filed will need to be with a fee.
Validity of EADs and Advance Paroles and processing times
Currently at the center (NSC) the EADs and Advance Paroles are only valid for one year.
The center (NSC) at present is at 60 days on the I-765s and almost through Aug on the I-131s. Within the next 6 weeks the I-131s should be within 60 days.
For most applicants, the A number issued with their I-485 will be their surviving A number
All A numbers for an applicant will be identified and files ordered for consolidation if necessary as all I-485 filings will go through a procedure called "Search and Assign". The surviving A number is shown by a set hierarchy and the rest of the A numbers will be consolidated into it. The A number issued with their I-485 will be their surviving A number for most applicants.
