Can I process I-140 with previous company

I got I-140 cleared through current company and labor approved from previous company. Can I process I-140 through previous company (to get PD to 2008)?

Yes, but only if the labor cert is still not time barred (within 180 days of its approval); the employer still has the intention to hire you some time before or after the approval of your green card; and you have the good faith intention of joining them.

I-140 process with L1A

My husband worked with L1B in a company as an sales engineer. Then, he just changed his job. Now, he just got his new L1A with the new company. His new company wants to get him greencard.

My question is his new company has been established two months ago. It is brand new. Do you think they can get an approval from I 140? As far as I know I 140 is shows if the company has been paying him well, the financial status of the company etc.
