should i (GC golder) apply for RTD to save money instead of RP?

May 9th 2012
I have GC dated since april 2008 and got it through asylum ofcourse. I also have a RP expiring next month june 2012. I am eligible to file for CITIZENSHIP next year. I intend to go for travel to india this coming winter season. I first wanted to reapply for RP which cost much more than RTD as RP is considered superior compared to RTD in my opinion and I like it much better but RP costs almost twice as much than the RTD and I am applying and probably receiving the citizenship next year anyway.
If within next 2 yrs, i am not doing international travel more than once and that too only for a month, isn't it better to just go for the RTD instead?

Reapplying for i-765

May 4th 2012
Hi,

My asylum is pending since june 2011 and my individual hearing is scheduled for 2014.I was suppose to apply for work permit in april 8th 2012 which was my 150th days but i've sent my application earlier and got denied because w it reaches USCIS the 148th day so i got denied.I was a little bit betrayed by the post office because my mail got there in 3 days and i thought that wouldl have taken 5 days. Now i've accumulated 175 days since clock is running.Should i refill the I-765 or the I-290 B.As i said i was denied because application got there 2 days earlier.Thank for helping

SHould 20 year old file N600 or the N400 citizenship application?

May 4th 2012
this is about a 20 yrs old girl, she has GC dated Since 2007 and her mother became naturalized US citizen in mid 2011. her mother was asylee. and the girl came to US in 2006 as a derivative asylee.

so bit confusing here is , should the 20 yr old child file N600 or the N400 if she wants to apply for US citizenship?

the mother has another child aged 12 and she just applied for N600 based on her mother and was easy and became citizen last month.

i know the general rule is: People 18 or older use form N400 to apply for citizenship. People who acquire citizenship from their parent/parents while under 18 years of age use form N600.

re entry permit is 1 or 2 year validity?

May 4th 2012
It has been a long time i haven't been following the great forum.

I have GC thru asylum since 2008. I currently have re entry permit document that expires in June 2012. Was valid for 2 years and I used it to travel to nepal in early 2011 for one month and that's it.

I plan to travel this winter and intend to file for re entry permit application again. My question is, will the new re entry permit document be valid for one year only or becos i already applied for one last time or it will still be valid for 2 yrs? if it will be for one year only then it is better to apply for RTD as it is much cheaper?

I remember in some cases, USCIS issues it valid for 1 year only but don't remember in what type of case.

Thanks guys.

Fee waiver and SSI for GC application

What document does a person receiving SSI benefits need to present while applying for fee waiver while applying for GC? How should one go about it? Any tips? Thank you kindly.

AOS pending for 2 years - is this normal?

May 1st 2012
I submitted my AOS (I-485) about 2 years ago but I still haven't received a green card. Is this normal? I've seen other asylum cases here and AOS lasts just a few months. What should I do? Thanks!

Renewing NP before GC? - I'm very confused

Apr 26th 2012
Hello all! This is my first post. I've been looking for an answer to my question but I cannot find a law about it and there's all sort of information online. So hopefully you will be able to help me.

I'm an asylee. What happens if I renew my NP before receiving my GC. Will I have trouble when I adjust status later? If there is a law or rule about this, can you point me to the web page that explains all this?

Thanks in advance!

My Citizenship

Apr 25th 2012
I got my Oath ceremony last week (04/17/12) in Oakland, CA, and now applying for my passport. I cannot give you the details and exact dates of my history here since I sincerely forgot them all :). I will have to open my archive folder for that and not really in the mood now, but feel free to ask me if there's anything you are curious about.

My journey began on 11/04/01, the date I entered US with brokenhearted (related to my asylum not to soulmate thing :) ). I applied for asylum one month after and got the interview around Feb the year after. This one is the most nervewrecking one compared to the series of interviews I had to go through during the whole process till I got my citizenship. They fully granted my aplication then and by summer 2002 I got my SSN and Working Permit already. Moving around and been living in 6 states for pursuing better jobs and better life until now I end up in the same city (SF) I came 11 years ago :) ...

Applied for my GC in 2006 and felt devastated once I found out that they (INS) lost my application. I made like 'thousands' calls and letters to them before finally they found my documents again (phew) ... it had moved around to 3 INS centers in 3 states (I have no idea why). I was just relieved that I didn't have to re-apply.
So by early 2008 I received my GC which was backdated one year before. Last December I applied for my citizenship and got interviewed in late Mar and had my Oath last week.

I am not saying that everything went smoothly, but pretty much (except for the "losing" period) it all went without big 'incidents' at all.
I joined this forum since 2007 and received a lot of helpful advices from you guys, not to mention scarry ones too :) ... but overall there are more benefits than discouragements.

Thank you guys and for you who are still on the way ... don't give up, always keep your spirit up and it's all worth it at the end!

When should I apply to renew my RTD?

Apr 9th 2012
Hello members,
When do you think I should apply to renew my RTD? My RTD will expire mid June and I am planning to travel on mid July. I am GC holder and can not get NP.

Is it a good idea to apply for RTD renewal 2 months before the expiration date of the current one?? The processing time shows 3 months

I will appreciate any response. Thank you

Help with the letter explaining why I went to COP. I need it for the N-400 interview.

Apr 3rd 2012
I have this 2 variations in mind. Which one do you think is better? Feel free to suggest revisions. Thanks!

#1 Quote: To Whom it May Concern:

I, Full Name, went for my grandfather's wake to COP in July of 2008. He helped raise me. I felt it was more important to be there for my grandfather than my fear of persecution.
I decided that the the risk of persecution was low since I have not been in COP for over 2.5 years and was going to refrain from any religious activities.

Sincerely,

Employment Authorization + Economic Necessity

Apr 2nd 2012
Hello everybody, this is my first post and I love the forum, it has been very helpful during this process. My question today is about getting an employment authorization, my complete application was received on January 5th and I still haven't received any notice from the Asylum Office (besides an Status Request Form telling me that my case is pending preparation of a written decision).

I have been unemployed since I came to the US almost a year ago now and the economy is very bad for me, I was already approved Food Stamps and waiting for Medicaid; I have a very good job offer now, USCIS said that I can't apply before 150 days after my application. Suggestions???

Thank you all in advance!!!

Former US Citizen going back to country of persecution (asylee)

Mar 26th 2012
Hi all,

I am very confused about this issue. I got my US citizenship about a month ago and I really want to go to my home country. It's has been almost 8 years since I left, I still have fear, but I am human and I would like to see my relatives that I haven't seen in many years, my father for example he just got diagnosed with eye cancer and my grandma is about to die very soon. See the plase where I grew up, etc. I don't want to risk my new status as a citizen in this country, but I only want to go there for visit, just for few days. Now based on your experiences, can you tell me if is any risk of loosing citizenship because of that? I am going to travel with my new US passport but I still need to use my national passport in order to enter my country. Please I need to hear some of your opinions.

Thanks a lot!

second fingerprint notice

Mar 12th 2012
Hi All;

I need your help, idea please.

I applied asylum in 2009 and interviewed but didn't hear the decision yet. I got mail for the second fingerprint notice last week from USCIS National Benefit Center. Is it a normal procedure? Is it a sign that my long waiting period is coming to an end? Is there anything I have to do in addition to the fingerprint?

Thank you

Refugee Travel Document vs. Schengen Visa

Mar 2nd 2012
Hello people, I will copy and paste the conversation between me and the Norwegian Embassy in San Francisco/CA. I just think the Embassies should be aware about the Travel Document...they look at it like it's an alien from Mars!!!

ME: Good morning Norwegian Embassy SF-CA

I live in Santa Barbara-California however I was born in Brazil and I have political Asylum. I just got my Refugee Travel Document and I was wondering If I need the "Schengen Visa" since I am not allowed to use the Brazilian passport anymore.
Can I go to Norway using the Travel Document or I need the "Schengen Visa"?

NORWEGIAN EMBASSY: You do need a visa. Please bring both your travel document and old passport to the interview. Guidelines are found here:

http://www.norway.org/Embassy/Visa-a...San-Francisco/

Regards,

SO, I GATHERED ALL MY PAPERS, BANK STATMENTS, PICTURES, COPIES OF THIS AND THAT BLAH,BLAH, BLAH...AND I DROVE FROM LOS ANGELES AAAAAALLLLLLLL THE WAY TO SAN FRANCISCO JUST TO GET MY VISA. I HAD MY INTERVIEW AND HE SAID THAT I WOULD GET MY RTD IN 5 BUSINESS DAYS...EVERYTHING WAS FINE.

...days later...

NORWEGIAN EMBASSY: Dear xxxxxxx,

I just left you a voicemail. As I was printing your visa I realized you’re a Brazilian national, who then would not normally need a visa to enter Norway. Do you still have your Brazilian passport, or is the U.S. Travel Document your current form of id? You may fall in between the various regulations, so I just want to make sure before I send your passport back (so you don’t have any issues on the border)

Regards,

ME: I would prefer to have the Schengen Visa even if you are not sure that it is required. Often, the airline personnel at the airport ticket counters or the cruise ship personnel at the ports are not familiar with the visa requirements. They tend to err on the side of caution. If I don't have a visa, I might be delayed boarding or denied a boarding pass altogether. I will be on a very tight timeline during my trip with a short connection in Germany and then only five days in Norway. Upon arrival in Venice, I will have only a couple of hours to get on the ship. So, any delay could ruin all of our plans.

As an asylee in the United States, I am forbidden from using my Brazilian passport for travel. I must use only the Refugee Travel Document issued by the United States or I risk losing my asylee status and could be deported to Brazil.

As I have paid the fees and provided all the required documentation, please issue the Schengen Visa.

Thank you so much

NORWEGIAN EMBASSY: Dear xxxxxxx,

UDI has confirmed that as a Brazilian national with a US-issued travel document, you do not need a visa to enter Norway. I have also checked that Italy and Germany accept U.S. travel documents in the same fashion .

As such, I have cancelled the visa in your travel document, since we cannot issue visas to citizens of countries that do not require such permission to travel. I will include a letter with your passport that explains why we have not processed your visa, in case you are worried about airline personnel/ border authorities.

I have of course refunded the visa fee (which will go back on your card). I sincerely apologize for the inconvenience this process has caused you.

Regards,

US Asylee becoming Permanent Resident in Canada (Spousal Sponsorship)

Feb 28th 2012
Hi there.
I am a US asylee since August 2011 (my case was pending for 2 and 1/2 years). I recently obtained Canada Permanent Residency through my spouse and would like to know if before leaving the US for Canada I should surrender my asylum status here in the US. I have a RTD and haven't adjusted my status yet to LPR. Will I be able to keep my status in the US and renew my travel document or apply for Re-entry permit from Canada?
Thanks.
